Troy cop arrested for tipping off drug dealers (UPDATED with DOCUMENTS)

A Troy police officer was charged with tipping off suspects about a drug investigation, according to Attorney General Eric Schneiderman, which allowed the suspects to remove narcotics.
Officer Brian Gross, a 10-year veteran, is charged with one felony of tampering with physical evidence as well as two counts of official misconduct and one count of obstructing governmental administration.

“Revealing confidential information threatens the safety of law-enforcement agents and jeopardizes criminal investigations,” Schneiderman said in a statement. “It’s particularly troubling to see an officer accused of abusing his position while violating the very laws that he’s sworn to protect.”

According to Schneiderman’s office, in 2013, the State Police Community Narcotics Enforcement Team had been investigating a drug ring in Rensselaer County. Gross was assigned to assist and had access to suspect information and information regarding the timing and location of search warrants.

In February, investigators executed search warrants at five locations where drug activity was observed - they found nothing and nobody was arrested.  

One of the residences searched was that of a suspect identified as “Person #2.” This person subsequently informed investigators that he’d been told by “Person #1” of CNET’s investigation into “Person #2” for drug trafficking and that a search warrant would be executed in the next few days.

According to the complaint, “Person #1” admitted receiving this information directly from Gross, who arranged in-person meetings via text message.

Further investigation revealed that Gross allegedly warned that “Person #2” had better “watch [his] back” because he had come to the attention of the State Police.

According to the felony complaint filed Wednesday, in the week prior to the execution of search warrants, Gross, again warned that there better not be any drugs inside the home of “Person #2” because “there was a good chance the police would be getting a warrant.”

In interviews with investigators, “Person #1” acknowledged warning “Person #2” to remove any drugs from his residence, based on the information from Officer Gross.

"The actions of this officer not only interfered with highly sensitive intelligence gathering on drug activity, it put the lives of our law enforcement officers in jeopardy," State Police Superintendant Joseph D’Amico said in a statement. "The success of these types of narcotics investigations could not be achieved without the hard work and dedication of our members working closely with our partners in law enforcement. It is unfortunate that this officer chose to breach that trust, abuse his authority and undermine a criminal investigation."

Gross, according to Talk 1300, is represented by attorney Steve Coffey, who told Channel 10, his client is innocent.

"We just met last night. We came in this morning I got to talk to him. I asked him he said I'm not guilty and beyond that I haven't had any discussions with him," Coffey told the television station. "I haven't talked to the Attorney General. I haven't really talked to Brian but that's where we are. There are serious allegations but we're defending them."

Gross pleaded not guilty in Troy City Court in front of Judge Chris Maier Wednesday morning. he was accompanied by Coffey and Police Benevolent Association President Bob Fitzgerald as well as a contingent of police officers. Protocol calls for him to be suspended without pay for no more than 30 days, at that point the department will determine what direction it takes regarding his future employment.

Gross was a member of the Emergency Response Team, an elite squad similar to a SWAT team, and spent time at the now defunct Special Operations Section, a squad that focused on long term drug investigations.

Police Chief John Tedesco said it was a "frustrating" situation and that he was aware of the State Police investigation since it began in February.

"He was a very competent and popular officer," Tedesco said. "There was a lot of work here and the career of a very good officer has been lost."

Now I don't agree with many things the chief says or does but that's in regards to our current crime situation and that's a whole different story. But I do believe the chief knows this officer has done wrong and will pay the ultimate price for this bad decision he made.End of story. PLEASE REREAD WHAT THE CHIEF HIMSELF SAID.If there really was a change as others have indicated on the subject, the chief would have publicly stated as such.

Almost immediately they painted up the streets. Now they are putting up license plate cameras and cell phone data grabbers on the street poles nearby.

    1) IF Rensselaer County still had the same dirty DA, you can all rest assured he would have helped this Dirty Cop come up with some lame excuse as to why he didn't do it.
    2) Hahaha The TROY PD are hurt because the AG's office and the State Police didn't let them in on Gross's Arrest? Hahahaha Think about it. They want the AG's office and the state police to do the same thing which Gross is accused of doing! Hahahaha That is priceless
    3) Let's see, we have one Troy cop who was arrested for attempting to hook up with a 14 year old girl from NYC (turned out to be a sting), Another Troy Cop as accused of sexual battery, but the case was dropped and now this guy, Gross, for several Misdemeanors and a Felony. What does that tell you about the Troy PD? Last week , Chief Tedesco said he was surprised to hear that police officers are responding to calls and telling people "There is nothing we can do". My guess is, it's about time for not only the State SG's office to step in, but the FBI as well. Heck, The FBI is already investigating the King Street Demolition and the South Troy redevelopment Project. Why not give them a little something else to investigate while they are in town. If you really want a "Cleaner Safer Troy" then clean up the Police Department, Fire Department and the crooked politicians currently in office. It's time to "Clean House" in Troy!« less

    He texted the perp! The police are all to commonly using their own or spouses cell phones to circumvent the recorded radio system. This happened in Bethlehem a few years ago when a DWI hit and run suspect escaped from an empty Hannaford parking night on a snowy winter night. Chuckie needs to ban the police use of private phones during work, period.

    @GotJunk Unfortunately, The Troy PBA had it written into the Officers contracts allowing them to use cell phones while on duty, for work use. So, when you see a TPO using his cell phone he/she can always claim it's work related. It would take a court order to have the cell record produced. Such was the case (several years ago) of the TPO returning to the station, after a long day at work. HE was on Lower 4th Street, near the Public Pool. A little boy was running after his sister because he wanted to go to with her to the pool. The officer was on his cell phone, Claimed it was official business. To prove the call wasn't "official business" a court order was required to obtain the cell phone records. The PBA and City Attorneys vigorously objected. They lost. The cell records indicated the officer was making a "PERSONAL" call at the time o the accident which caused the child's death. The City Settled the case out of court.« less

  32. In a show of support a radio station was reporting officers lined the hallway where the officer was escorted. Patting his back showing support? Really, I know he isn't guilty until proven so, but the NYS Police are a pretty good operation that looked at this for some 6 months. I bet he is and only an inexperienced deputy district attorney can get him off, which most likely will happen when Steve Coffee comes to town. He is the guy that gets all the bad guys off and back on our streets. As a side note, that's a pretty crappy way to practice law.

    Because he works 18 hour days 7 days a week to provide for his family . To bring his wife in this too, really get a life she works just as hard as he does. What issues are going on in the neighborhood where you own property? What are the neighbors like on each side of the residence you own? What day of the week is garbage pick up at that residence? Are the garbage cans in acceptable shape? Has code ever responded to any of the residences near your property? How is your property after the most recent heavy rainfall? Just curious Justin since you seem to KNOW so much, which councilman is in your district, how do you feel about the major increase in crime this year? What are YOU doing to ensure your property is safe? If you can answer all those questions under 3minutes then yes, you can say whatever you want on the issue,if not, put a cork in it

People are dying everyday from these drugs and he wasn't helping the problem by warning these scumbags that they were under investigation!!! And him as a police officer should know all to well going on call after call to overdoses! So regardless of what his wife does, what kind of house he lives in and who he's related to, he did something wrong got caught and now will pay for it for the rest of his life!

As a tax paying resident of the City of Troy, I do NOT support that officer and do NOT believe City residents should pay his salary. They say he only has 30-days on leave without pay then they put him back on the payroll even though he is NOT working.This,wouldn't happen in the private sector.
